This article will develop an analytical method to determine whether copyright infringement of software has occurred. This three-part test, based largely on Learned Hand's abstractions test, allows courts to rely on well-established and familiar principles of copyright law, yet, at the same time, it provides the predictable results necessary to foster innovation and development within the computer industry.
